Terms of Service
Effective: April 2026 | Rise & Shine Aging in Place Consulting, LLC
1. Nature of Services
Rise & Shine Aging in Place Consulting, LLC provides in-person consultative and educational services. Because these services involve the professional time, preparation, travel, and expertise of Amy O'Hern, COTA/L, they are non-tangible and cannot be returned. All sales are final once a service has been rendered.
These services do not constitute medical care, occupational therapy treatment, nursing, or any other licensed healthcare service. Recommendations made are informational in nature. Clients and their families are responsible for decisions made based on Rise & Shine guidance.
Rise & Shine is a private-pay service. Services are not covered by Medicare, Medicaid, or private insurance. Payment is the responsibility of the client or their family.
2. Service Offerings

| Member Add-On Visit | Additional visit for active monthly members at a reduced rate |
3. Cancellation Policy for One-Time Services
Cancellation by Client (24+ hours before appointment)
- Full credit toward rescheduling. No penalty.
- No cash refunds for pre-paid appointments that are cancelled.
Cancellation by Client (less than 24 hours before appointment)
- Appointment is forfeited. No credit or refund.
- A new booking and payment is required to reschedule.
Cancellation by Rise & Shine
- If Amy must cancel due to illness, emergency, or circumstances beyond her control, clients will be offered a full reschedule at no additional charge, or a full refund if rescheduling is not possible.
After Service Is Rendered
No refunds are issued once a visit has taken place and the service has been delivered.
4. Monthly Membership Terms
Billing
The Monthly Membership is a recurring subscription billed automatically on the same calendar date as the original enrollment date. Payment is processed securely through Stripe.
What's Included Each Month
- 1 monthly in-home check-in (scheduled by member via online booking)
- 1 monthly phone check-in (scheduled by member via online booking)
- Ongoing safety monitoring with running records of the home
- Priority scheduling over non-members
- Quick questions and support between visits via text or email (responded to within 1 business day)
- Member add-on visit rate for additional visits
What's Not Included
- Additional in-home visits beyond the 1 monthly check-in (available at the member add-on rate)
- Post-hospital or change-in-condition reassessments (billed separately)
- Emergency or on-call response. This is not an emergency service.
- Medical advice, therapy, nursing, or any licensed healthcare services
- Services that require physical assistance or hands-on personal care
Unused Monthly Benefits
Monthly in-home check-ins and monthly phone check-ins do not roll over. Benefits unused within the billing month are forfeited. This ensures Amy can maintain consistent scheduling for all members.
Cancellation of Membership
Members may cancel their subscription at any time by:
- Using the Stripe customer portal link provided in the original confirmation email, or
- Emailing info@riseandshineaging.com directly.
Cancellations must be received at least 7 days before the next scheduled billing date to avoid being charged for the following month. Cancellation requests received within 7 days of the next billing date will take effect after that billing cycle.
Refunds for Monthly Membership
No partial refunds are issued for the current billing month once payment has processed. Membership benefits remain active through the end of the paid billing period, regardless of when cancellation is requested.
Exceptions may be considered on a case-by-case basis for extraordinary circumstances (e.g., death, serious medical emergency). Requests must be submitted in writing to info@riseandshineaging.com within 14 days of the charge.
Membership Pause
Amy may, at her sole discretion, offer a 1-month courtesy pause of membership billing for documented circumstances such as hospitalization or extended travel. This is not a guaranteed benefit. Requests must be submitted in writing before the next billing date.
5. Payment Processing
All payments are processed securely through Stripe. Rise & Shine does not store credit card numbers or payment credentials. By completing a purchase, clients agree to Stripe's terms of service.
In the event of a failed payment, Stripe will automatically retry the charge and notify the client. Access to membership benefits may be paused if payment cannot be collected.
6. Disputes & Chargebacks
We encourage clients to contact us directly before initiating a chargeback or payment dispute. Many concerns can be resolved quickly.
Chargebacks initiated for services that were delivered as described may result in termination of the client relationship.
